CAROLINA COAST ATHLETICS LLC WAIVER AND RELEASE OF LIABILITY In consideration of the Participant listed above (“Participant”), my minor child/ward, being allowed to participate in any way in the Carolina Coast Athletics program, related events, competitions, clinics, and activities, the undersigned knowingly and freely acknowledges, appreciates and agrees that: 1. Cheerleading, tumbling, and gymnastics are vigorous sporting activities involving height, rotation, speed, and physical exertion in a unique environment and, as such, pose a significant risk of injury. Cheerleading/tumbling and related activities always involve certain risks, including, but not limited to death, serious neck and spinal injuries and serious injury to bones, joints and muscles. The risk of such harm may be limited by safety equipment and coaches, but will never be eliminated; 2. I on behalf of myself, Participant, my spouse, and on behalf of my/our heirs, executors, administrators, legal representatives, and assigns, KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, and EVEN IF ARISING FROM THE NEGLIGENCE of those persons released from liability below, and assumes full responsibility for Participant’s participation; 3. I willingly agree to comply with Carolina Coast Athletics’ standards and customary terms and conditions for participation in Carolina Coast Athletics activities. If I observe any unusual and significant concern in Participant’s readiness for participation and/or in the Carolina Coast Athletics program itself, I will remove Participant from participation and bring such issue to the attention of the nearest Carolina Coast Athletics personnel immediately. 4. I on behalf of myself, Participant, my spouse, and on behalf of my/our heirs, executors, administrators, legal representatives, and assigns, HEREBY FULLY RELEASE CAROLINA COAST ATHLETICS LLC, AND THEIR RESPECTIVE EMPLOYEES, MANAGERS, TEACHERS, COACHES, MEMBERS, OFFICERS, AGENTS, CONTRACTORS, SUBCONTRACTORS, AND OTHER PROGRAM PARTICIPANTS, SPONSORING AGENCIES, SPONSORS, ADVERTISERS, AND IF APPLICABLE, OWNERS AND LESSORS OR PREMISES USED TO CONDUCT CAROLINA COAST ATHLETIC PROGRAMS (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH OR LOSS OR DAMAGE TO PERSONAL PROPERTY INCIDENT TO PARTICIPANT’S INVOLVEMENT OR PARTICIPATION IN CAROLINA COAST ATHLETICS PROGRAMS, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW and 5. I on behalf of myself, Participant, my spouse, and on behalf of my/our heirs, executors, administrators, legal representatives, and assigns, HEREBY AGREE TO HOLD HARMLESS AND CONVENANT NOT TO SUE all above Releasees, from any and all liabilities incident to participation and involvement in Carolina Coast Athletics programs, even if arising from the negligence of Releasees, to the fullest extent permitted by law. 6. I hereby grant and authorize, in perpetuity, the use of the participant’s photo to Carolina Coast Athletics LLC for promotional and marketing purposes. Uses of the photo include (but are not limited to) website imagery, social media, and marketing for programs and events. Digital images will be provided to parents for personal use along with a photo release so prints and replication may be authorized.
